Scout Africa Ltd (“Scout Africa”) is a company organized and existing under the laws of the Republic of Ghana. The Scout Africa platform comprises this website and acts as an intermediary connecting people ("Customers") with experience organisers ("Organisers") for booking activities, tours, and other travel-related experiences ("Experiences"). By using our platform, you agree to these Terms and Conditions. Please read them carefully.
1. Acceptance of Terms
By accessing, using, or booking an Experience through our platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, you must refrain from using our services.
2. Role as an Intermediary
Scout Africa acts solely as an intermediary between Customers and Organisers. We do not operate or provide Experiences ourselves and therefore are not responsible for the quality, safety, legality, or availability of any Experience. All bookings and participation in Experiences are subject to the terms and conditions of the Organisers providing them.
3. Bookings
When you book an Experience through Scout Africa, you are entering into a contract with the Organiser, not with Scout Africa. We facilitate the booking process but do not provide the Experience. All information regarding the Experience (including dates, prices, inclusions, and restrictions) is provided by the Organiser, and it is your responsibility to review this information carefully before booking.
4. Payment Terms
All payments for Experiences are processed through Scout Africa on behalf of the Organiser. By making a booking, you agree to pay the full amount listed at the time of purchase. Payment must be made at the time of booking, and no booking is confirmed until full payment has been received.
5. Cancellation Policy

Cancellation by the Customer: If you wish to cancel your booking, you must contact Scout Africa as soon as possible. The refund or cancellation policy applicable to your booking will depend on the Organiser’s terms and conditions, which will be clearly stated at the time of booking.

If the Organiser allows cancellations, you may be entitled to a full or partial refund based on their policy.

Scout Africa is not responsible for any cancellation fees imposed by the Organiser.

Cancellations made less than 48 hours before the start of the Experience may not be eligible for a refund.

Cancellation by the Organiser: If an Organiser cancels an Experience for any reason (e.g., weather conditions, safety concerns, lack of availability), you will be notified as soon as possible, and a full refund or rescheduling option will be offered. However, Scout Africa is not liable for any additional costs or losses incurred due to such cancellations (e.g., travel, accommodation, etc.).
6. Refund Policy

Refund eligibility is subject to the Organiser’s terms. If eligible, refunds will be processed through the original payment method.

Refund requests must be submitted in writing via email to hello@scoutafrica.co within 7 days of the cancellation notice.

Refunds for cancellations initiated by the Customer will be processed within 14 days of approval.
7. Liability and Limitation of Responsibility

Scout Africa is not liable for any direct, indirect, punitive, or consequential damages arising from the use of our services or participation in Experiences booked through us.

You agree that your participation in any Experience is at your own risk and that you are solely responsible for reviewing and understanding the Organiser's safety policies, restrictions, and disclaimers.

Scout Africa does not guarantee the performance or safety of any Experience. Any concerns or claims related to the Experience should be directed to the Organiser.

You acknowledge that many Experiences may carry inherent risks (e.g., adventure sports, wildlife encounters, etc.), and it is your responsibility to ensure that you meet any physical or skill requirements and to purchase appropriate insurance coverage.
8. Insurance
Scout Africa strongly recommends that all Customers purchase travel insurance, including coverage for trip cancellations, personal accidents, medical expenses, and loss of personal belongings. Scout Africa does not provide insurance for Customers, and any insurance claims must be made through your provider.
9. Organiser Terms and Conditions
Each Organiser may have its own terms and conditions, including cancellation, refund, and liability policies. It is your responsibility to review and understand these policies before booking. By making a booking through our platform, you agree to be bound by the Organiser’s terms in addition to these Terms and Conditions.
10. Customer Obligations

You agree to provide accurate, current, and complete information at the time of booking.

You agree to comply with all applicable laws, rules, and regulations while participating in any Experience.

You agree to respect and follow all instructions provided by the Organiser or its representatives during the Experience.

Failure to adhere to these obligations may result in your removal from the Experience without refund.
11. Image and Media Consent
By participating in any Experience booked through Scout Africa, you give express consent for Scout Africa and/or the Organiser to capture and use your image, likeness, video, or any media taken during the Experience for marketing, promotional, and advertising purposes. This includes, but is not limited to, usage on websites, social media platforms, promotional materials, and advertising campaigns.
You acknowledge that these images and recordings may be used without any further notice or compensation.
If you do not wish to have your image or media used for these purposes, you must notify Scout Africa in writing prior to participating in the Experience.
12. Complaints
If you have any complaints about the Experience, you should raise them directly with the Organiser at the earliest opportunity. If you are unable to resolve the issue with the Organiser, you may contact Scout Africa, and we will do our best to assist in mediating the issue, although we are not obligated to resolve disputes between Customers and Organisers.
13. Changes to Experiences
Organisers may modify or change the details of an Experience due to unforeseen circumstances (e.g., weather, safety issues). Scout Africa is not responsible for these changes, and any rescheduling or compensation will be subject to the Organiser’s policies.
14. Privacy
Your personal information will be handled in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and sharing of your information as outlined in that policy.
15. Force Majeure
Scout Africa is not liable for any failure or delay in performing its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, war, strikes, natural disasters, or pandemics.
16. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of The High Court.
17. Amendments
Scout Africa reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them periodically. Continued use of our platform constitutes acceptance of any such changes.
By using Scout Africa to book Experiences, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
